1. Who we are and what these terms cover

These Terms & Conditions (“Terms”) are between you and Hellstar World, a trading name used for the online store at hellstarworld.com (“we”, “us”, “our”).

By browsing this site, creating an account, or placing an order, you agree to these Terms. If you do not agree with them, please do not use the site or place an order.

These Terms cover how you may use the site and how we sell to you. They sit alongside three other policies, which form part of them:

• Shipping — costs, delivery times, tracking and customs

• Returns & Exchanges — the 30-day return policy and how to use it

• Privacy Policy — how we handle your personal data

Where those policies are more specific than these Terms on a particular subject, the specific policy applies.

2. Eligibility

You must be at least 16 years old to place an order or create an account. If you are 16 or 17, you may only order with the involvement and agreement of a parent or legal guardian, who is responsible for the purchase. By ordering, you confirm you meet these requirements.

We may ask for age or identity verification on any order and may cancel an order if we cannot confirm eligibility.

3. Your account

You do not need an account to order, but you may create one. If you do:

• you must give accurate, current information and keep it up to date;

• you are responsible for keeping your password confidential — do not share it;

• you are responsible for activity that happens under your account;

• tell us immediately if you suspect unauthorised use.

We may suspend or close an account that is used fraudulently, abusively, or in breach of these Terms.

4. Orders and our acceptance of them

Submitting an order is an offer to buy from us. It is not a binding contract until we confirm it.

• An order is created only once payment has been confirmed and our checkout shows a completed order. A declined payment leaves no order and no charge.

• We send an order confirmation, and a separate dispatch confirmation when the parcel leaves our warehouse. The contract between us is formed when we send the dispatch confirmation.

• We may refuse or cancel an order — with a full refund — if the item is out of stock, if the price or description contained an obvious error, if we suspect fraud, or if we cannot ship to your address. If we cancel, we refund you in full.

• Order details in your account and in your confirmation email are the record of what you bought. Please check them and tell us straight away if anything is wrong.

5. Prices, currency and payment

• All prices are shown in US dollars (USD) unless stated otherwise.

• The price you pay is the price shown in the cart at checkout. Shipping is added where applicable (see Shipping).

• Prices and availability can change at any time, but a change will not affect an order we have already confirmed.

• We accept PayPal, credit and debit cards, and Zelle for US orders. Card payments are processed by our payment provider — we never see or store your full card number.

• If a price is listed incorrectly and the error is obvious, we may cancel the order and refund you rather than honour the incorrect price.

• Coupon codes: one code may be used per order. Codes cannot be combined, have no cash value, and may be withdrawn at any time.

• Bulk and wholesale pricing applies from a mixed cart of 10 pieces and is quoted per order. Bulk terms are confirmed in your quote.

6. Shipping and delivery

Shipping costs, handling times, delivery times, tracking and customs duties are set out in our Shipping policy, which forms part of these Terms.

Two points are worth repeating here:

• Delivery estimates are estimates. Our stated times are typical, not guaranteed, and depend on carriers and customs in your country.

• Import duties and taxes are your responsibility. They are charged by your customs authority, payable by the recipient, and not refundable by us. We cannot mark orders as gifts or under-declare value.

7. Returns, refunds and exchanges

Returns, refunds and exchanges are governed by our Returns & Exchanges policy, which forms part of these Terms. It sets out the 30-day window, the condition items must be in, and who pays what.

8. Product information and images

• We describe our products as accurately as we can, including materials, measurements and available sizes.

• Photographs are for illustration. Colour and finish can look slightly different in person, and can vary between production batches and between screens. A minor variation of this kind is not a fault.

• Measurements and size guidance are approximate. Our garments are cut with a relaxed streetwear fit that differs from standard high-street sizing. Please use the size guide on the product page rather than assuming your usual letter size.

• If you believe an item you received is materially different from its description, contact us — we will make it right under the Returns & Exchanges policy.

9. Independent retailer and trademarks

Hellstar World is an independent retailer. We are not affiliated with, endorsed by, sponsored by, or acting as the official website of the Hellstar or Godspeed brands, or of any other brand whose products appear on this site. We are not an authorised dealer or an official stockist of those brands.

All brand names, logos and trademarks that appear on this site belong to their respective owners and are used only to identify and describe the goods.

If you are a rights holder and believe content on this site infringes your rights, contact info@hellstarworld.com and we will respond promptly.

10. Intellectual property in this site

All content on this site that we own — our text, page layout, photography we have produced, and the site design and code — is protected by copyright and may not be copied, reproduced, distributed or used commercially without our written permission.

You may view, download and print pages for your own personal, non-commercial use, and share links to our pages.

11. Acceptable use

You agree not to:

• use this site for any unlawful purpose, or in breach of any applicable law;

• attempt to gain unauthorised access to the site, its servers or any connected system;

• introduce viruses, malware or any other harmful code;

• scrape, crawl or bulk-extract content or product data without our written consent;

• interfere with the site’s normal operation, or place an unreasonable load on it;

• place orders in bad faith, including fraudulent orders or orders you do not intend to pay for;

• impersonate us or misrepresent a connection with us.

We may block access, cancel orders and take legal action where these rules are broken.

12. Third-party links

Our site may link to third-party services, such as 17track for parcel tracking, or to our social profiles. Those sites are not under our control and we are not responsible for their content, products or privacy practices. A link is not an endorsement.

13. Availability and changes to the site

We may change, suspend or withdraw any part of the site, including products and prices, at any time. We do not guarantee that the site will always be available, uninterrupted or error-free. Where a change affects an order we have already confirmed, we will contact you.

14. Limitation of liability

Nothing in these Terms excludes or limits our liability for:

• death or personal injury caused by our negligence;

• fraud or fraudulent misrepresentation;

• any other liability that cannot lawfully be excluded.

Subject to that:

• We are responsible for loss you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care. We are not responsible for loss that is not foreseeable.

• We are not liable for business losses. We sell to consumers for personal use, and we are not liable for lost profits, lost business, lost opportunity or business interruption.

• We are not liable for delays or failures caused by events outside our reasonable control (see section 15).

• Our total liability in connection with any order is limited to the amount you paid for that order.

15. Events outside our control

We are not liable for any failure or delay caused by something outside our reasonable control, including carrier strikes or failures, customs delays or seizures, extreme weather, natural disasters, epidemics, war, or failures of the internet or public infrastructure. If such an event affects your order, we will contact you and, where the delay is substantial, offer a refund.

16. Governing law and jurisdiction

These Terms and any dispute arising out of them or out of your use of the site are governed by the laws of the State of California, United States, and the courts of Los Angeles County, California have exclusive jurisdiction — subject to the paragraph below.

If you are a consumer resident in the European Union or the United Kingdom, nothing in these Terms removes the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in the courts of your own country. Where the law of your country gives you a right that is stronger than anything in these Terms, that right applies.

Before starting formal proceedings, please contact us. Most issues are settled in a message.

17. Changes to these Terms

We may update these Terms at any time. The version that applies to your order is the one in force when you placed it. For changes that affect how we sell, we will publish the updated Terms on this page with a new “Last updated” date. Continuing to use the site after a change means you accept the updated Terms.

18. General

• Severability. If any provision of these Terms is found unenforceable, the rest remains in force.

• No waiver. If we do not enforce a provision on one occasion, we do not lose the right to enforce it later.

• Entire agreement. These Terms, together with the Shipping, Returns and Privacy policies, are the whole agreement between us on this subject.

• Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example if we sell the business.

• Third parties. No one other than you and us may enforce these Terms.
